In the wake of PTS’s closure, carhaul employers are trying to violate the national contract and deny the right of PTS Teamsters to follow their work.

This attack on our contract, our solidarity, and on Teamsters who struck when they were called out by the International Union cannot be tolerated. All these Teamsters ask is that Article 5 of the contract be honored by Jack Cooper, Allied, Cassens and Active Transportation.

At the national grievance hearing today, the employers refused to abide by the contract, and deadlocked initial cases, including Kentucky Local 651 vs. Cassens, and Dallas Local 745 vs. Jack Cooper. Those hearings will continue tomorrow, but the initial cases show that a stronger stand will be needed to protect our jobs and seniority rights.

June 27, 2008: The International Union is being even more secretive than usual about what is in the proposed tentative carhaul contract.

As reports of concessions leak out, members are ready to demand some answers.

We know that it’s a three-year deal, which very likely means that Allied Teamsters would get stuck with an extra year of wage cuts: their concession deal expires in two years, but has no “snap back” clause to automatically bring them back to union scale. A two-year contract would put all carhaulers back on the same page.

Car hauler drops motion to stop Teamsters strike

Performance Transportation Services Inc. today dropped its motion for an injunction to stop the Teamsters strike against the car hauler.

A spokeswoman for Performance Transportation Services said the move was related to negotiations with the Teamsters but declined to elaborate. A hearing on the motion had been scheduled for 2 p.m. today in U.S. Bankruptcy Court in Buffalo, N.Y.

Performance Transportation Services’ major creditors have asked a judge to convert the case to a Chapter 7 liquidation from a Chapter 11 reorganization.

A hearing on the motion is scheduled for Tuesday, June 17. At the creditors’ request, the judge in the case moved the hearing forward by almost a month. In court filings, the creditors said the strike has effectively dashed any hopes that Performance Transportation Services might have had of remaining viable.

Today, the United States Bankruptcy Judge overseeing PTS’s Chapter 11 case approved a 15% reduction in the wages or our teamster employees. This reduction was approved for an 8 week period ending July 31st, and this is temporary in nature.

Teamsters Call on PTS to Return to Multiemployer Talks

Teamster carhaul local unions will be holding strike votes this weekend after Performance Transportation Services, Inc. (PTS) filed 1113-E relief in bankruptcy court and requested 15 percent wage concessions.

PTS’ filing followed the company’s decision May 29 to withdraw from multiemployer contract talks that have been under way.

“PTS management’s actions during the late stages of talks are completely unacceptable and we are pursuing options in federal court to compel PTS to return to the multiemployer negotiations immediately,” said Fred Zuckerman, Teamsters Carhaul Division Director and lead negotiator. “We simply cannot allow PTS to walk away from negotiations at the 11th Hour — PTS is acting in bad faith by walking away now after several months of negotiations.”

DETROIT — While General Motors is restarting truck production it had halted because of the UAW strike at American Axle & Manufacturing Holdings Inc., auto dealers say they’re in no hurry to get more trucks on their lots. They have plenty.

Even though GM stopped filling orders for some trucks this month, dealers around the country interviewed today said they’re not losing truck business because of American Axle-related inventory problems.

“We’ve got a lot of inventory that’s still sitting on the ground,” says Doug Niemeyer, sales manager for Buick, Pontiac and GMC at Bommarito Automotive Group in Ellisville, Mo.

Legendary names Hugh E. Sawyer president

Founder Peter Bos to still serve as CEO

DESTIN — Hugh Sawyer said he was just trying to enjoy his retirement in the area. But Legendary Inc. had different ideas.

After signing on as an executive with Legendary Marine last August, Sawyer has recently stepped up to become president of all of Legendary’s holdings. Company founder Peter Bos will remain chairman of the board of directors and chief executive officer, according to a press release from Legendary.

Now here is a story.

In his 30-year business career, Sawyer has earned a reputation as a “turnaround specialist.”

His last mission as CEO of Allied Systems Holdings was to lead it out of Chapter 11 bankruptcy. The Atlanta-based hauler of cars, trucks, and sport utility vehicles did just that in May 2007.
