Teamster Leaders Will Identify Workers’ Concerns

Teamster carhaul members have voted to reject the proposed 2008-2011 National Master Automobile Transporters Agreement and all of its supplements.

Throughout the 2008-2011 contract negotiations, the union sought first and foremost to preserve and protect the members’ job security and job opportunities in an auto industry that is suffering from economic upheaval.

“The proposed agreement eliminated various restrictions so that our contracted employers could haul more cars, thereby providing additional job opportunities to our members and protecting their job security,” said Fred Zuckerman, Teamsters Carhaul Division Director. “However, our members have made it clear that they do not accept the proposal.”

“Now that the ballots have been counted and the contract has been rejected, we plan to speak to our members and our carhaul local union leaders to discuss the issues behind this defeat,” Zuckerman said. “We will get our members’ input on the issues that concern them. We understand that our members are worried and angry about the difficult economic conditions facing the auto and carhaul industries. We hope to resolve this contract without going on strike.”

    Carhaul members attending local union meetings this past weekend voiced nearly unanimous support for the tentative agreement, including a 183-2 vote to recommend the agreement at Local 299, the largest carhaul local union in the United States.
    “From Local 299 in Detroit, to Local 449 in Buffalo, to Local 25 in Boston, our members are overwhelmingly in support of the tentative agreement and the supplements,” said Fred Zuckerman, Director of the Teamsters Carhaul Division. “Once the members hear the details and get their questions answered, they have a better understanding of the issues. These have been excellent meetings.”

    Carhaul Concessionary Contract Rejected

    August 12, 2008: Rank-and-file carhaulers have flexed their muscles and decisively rejected a tentative agreement loaded with concessions.

    Their vote will send union negotiators back to bargain a more acceptable contract.

    Tom Landwehr, a rank-and-file observer told us from the count site in Maryland that “I was nervous about it this morning, but the No votes just kept piling. I feel good about our own Local 327—we had a good vote there. The members were just fed up with the massive concessions.”

    Landwehr, a Jack Cooper driver, traveled from Nashville to Maryland on his own time and own dime to help ensure a fair vote, as did several others.

    The national contract was rejected by 2,939 to 2,076, and all three supplements were rejected as well. The Central-Southern supplement was rejected 2,555 to 1,500, the East by 316 to 304, and the West by 184 to 171.

    Most of the bigger locals where members haul out of auto assembly plants rejected the deal, some by big margins. It went down in Kansas City Local 41, St. Louis Local 604, Lansing Local 580, Ft. Wayne Local 414, Dallas Local 745, San Jose Local 287, Lordstown Local 377, Chicago Local 710, Moraine Ohio Local 957 and others. Most of the smaller locals rejected it as well.

    It was the massive list of concessions, which would have gutted decades of hard-won contract protections, that sent the proposed agreement down to defeat.

    It took something else to win this battle. It took a growing network of carhaul Teamsters, stewards and some local officers who worked together and with TDU to build solidarity and also to safeguard the vote process.

    The time is now for the International Union to listen to the rank and file and make some serious improvements before coming back for another vote.

    It’s time for rank-and-file carhaulers to continue to build a strong network that can carry the battle forward.

    I think for atleast today we can all breath a sigh of relief and enjoy our win over this terrible contract that was offered to us. But that is for today and today only, now is the time that we all need to push even harder and try to educate the rest of the members who just follow like lambs to the slaughter. The more people we can tell about our differant avenues of communication with each local the better we will all be even if we cannot all agree with each other we all need our voices heard. The IBT and The TDU both have there own feelings and the way they want stuff to go and I don’t see any where for our daily beliefs or comments that is why this type of site and others out there are so important to all of us and our way of life. Now is the time to tell as many carhaulers as you can and have them tell as many carhauls as they can by doing this we will get our voices heard and achieve a fair and equitable contract and future for all of us.

    While I, along with others were observing the process of gathering, grouping, separating and then counting the ballots, it is very clear there is much more work the members need to do to insure a “fair & accurate” vote count. The only real eligibility check for all ballots cast in this referendum, was done at the front end when they were mailed out. By the way, there were about 11075 ballots mailed out, but as I understand, less than 9,000 members in the carhaul industry. The number of returned ballots was unofficially, 5351. Granted, some members may be on lay off with 7 year recall rights which thankfully do allow them to vote…… but over 2000? really? How accurate could the “front end” check of eligibility have been? We were told such a large number of ballots were sent out so as to allow for the largest number of interested carhaulers to participate. What happed to sending out ballots to members who are eligible at that time, then counting the ballots of those who are eligible on the day of counting ballots? Was there an effort to “pad” the vote, fuzzy math or just trying to include more members? Every one of us members had better be asking, then insisting upon refining the process to make it accurate. Every ballot/vote should be determined if eligible or not, on the day of counting, and only those properly determined as eligible….to be counted.

    By the way, there were over 254 ballots set aside as “challenged” from many locals, which were former PTS members. These ballots were not counted, citing that these members had NOT transferred or been hired onto a union carrier employment roster as of the day of counting ballots. Even though some of these members may within days or weeks be employed, their voices were silenced and votes NOT counted. Some of the NOT counted ballots of PTS members are as follows; Local Union#449 90 ballots, #964 33 ballots, #377 26 ballots, #25 18 ballots, #312 15 ballots, #560 13 ballots and the list goes on.

    Many ballots were collected from members who had been retired, fired, quit etc. and were to be counted in the tally. Few were challenged and removed. Some of these had not been active carhaulers for a long time and were not eligible in any way shape or fashion, but without an eligibility check for each ballot at the time of ballot counting, many were and will be part of the official tally. Like having a blind quality control inspector checking paint jobs as vehicles roll off an assembly line!

    Members need to assert and expand their rights to observe and challenge during every referendum ballot count. Several of the observers, myself included were always watching, noting, asking questions and taking notes. Several were not, content to just sit in a chair, silently taking no notes. They either had photographic memories thus requiring no notes, and telepathic thus requiring no questions, or they were there for other reasons? The process was civil and courteous, all questions asked were answered. I do wish to credit those who played a role in insuring this atmosphere.

    I am happy to be part of TDU’s efforts in the battle for “observer” rights, and respectfully ask ALL members to consider getting off the bench and onto the field by joining the TDU network of members who ARE making a difference. If you have reservations or questions about TDU, that is great. I too, many years ago had to the same. However, I asked the hard questions, researched to know the “heart & intentions” of this organization, the history of the many great acheivements TDU & teamster members have accomplished which benefited rank and file members………when the “home work” and “research” is done….. you too can feel fine in joining this excellent organization of fine folks with honorable goals and ambitions! There will be rumors and nay sayers, make them prove their points or acuzations. Ususally it goes like this about negative comments about TDU ….I say show me? *&^&%&^*&&($##@ (foul language) pours out, but substance or truth is absent in the response. There is much work to be done, to those who know this to be true, I challenge you to help in getting it done. Log onto the TDU web site to get informed and involved! Semper Fi!

    Yes I would vote for a 2 year deal status quo with a full snap back into full wage then maybe the economy and industry will be in a better shape to properly negotiate a good contract and you bet your ass we will have to have a large pay incease then or like you say just lock them down and we all look for work somewhere else but with our heads held high

    GOT A QUESTION, THE PTS TERMINALS THAT ALLIED TOOK OVER, ARE THE DRIVERS BEING PAID FULL RATE, OR DO THEY HAVE TO TAKE THE 17% CUT.

    THE AGREEMENT THAT PTS DRIVERS WOULD TAKE A CUT, WHEN THE ALLIED DRIVERS VOTED TO CHANGE THERE AGREEMENT WITH THE TEAMSTERS, DID THAT TAKE EFFECT EVEN IF THEY DIDN’T BUY PTS???

    The Olympic trials for Carhaul negotiators is complete. There will be no Gold, Silver or Bronze medals awarded to each of those who tried to sell the sorry concessionary proposals to the members. Voted down by a margin of about 60% to 40% by rank and file Carhaulogists across the nation, the only medals or “metal” this entire panel has earned, should be from the members steel toe boots in the hiney….. but NO medals! The employers however, are hoping to use them again, as a kind of second string, slight of hands, shell game, giveaway committee! Boy Scout motto……Be Prepared! Our industry is still bleeding from all the other sell outs and giveaways from the last two contracts. Remember those? A bonus in lieu of a pay raise? A two year wage freeze? New Business language that built in likely incentives to “loose” or “give” away traffic, then later bid as “New Business” for half rate? New Business half rates that never snap back to full or frozen rate?

    As the line between a Strong Contract and Strong Sellout get blurrier, members must speak out to our General President…..enough is enough! Leopards don’t change their spots. Clean house of those who have been “weighed and measured and been found wanting”……… wanting more concessions! Saying or voting yes to “Concession Addicts” will only perpetuate the addictions. A good healthy dose of loud and clear “NO”s from the membership is a reality check which is long overdue! We must stop the “bleeding”! Have any of the concessions given over the last two contracts ever put members in better circumstances? Did the seniority boards grow in numbers? Is there any organizing going on in our industry?

Thank you John and all the members at Local 604, for standing up for all Carhaulogists, may your web site get so much traffic that the red phone in the marble palace……. melts down!

    Every member should call their Local Union to “insure” they have the correct mailing address and current information. Every member should get in the loop and stay tuned into every aspect of these negotiations. The TDU web site (www.tdu.org) is an effect resource for this effort. And, if we Carhaulogists really want to have a much louder voice in these matters, I sincerely suggest you get off the bench and onto the playing field by signing up for the “contract updates” and joining as a member! I know tex fuck the paycut but I’m not working so thats alot more of a paycut than 15%! Imagine going from Baltimore maryland to Long Island,ny for less than $175 bucks and then have to dead head back to baltimore!     Right now our Carhaul industry and labor in general, are in troubled waters. Some of the turbulence is from a poor economy, weak US dollar, speculators, election year and other uncertainties.

    Much of the turbulence however, is due to greed, lies & distortions, disloyalty to honorable causes and needs, lack of good direction, lack of focus and lack of old fashion “roll up the sleeves” hard work! These traits are obvious in the VERY POOR leadership in our union and in our nation. In fact, if we are honest, these traits are in our ranks, and in our Teamster leaders, and in both democrats and republicans. Nothing new here. Much sifting is going on in many hearts.

    But… to every one of us who are doing nothing about these concerns, other than complaining……. are part of the problem as well. Meanwhile, the bleeding continues.

    Battle Plan: Lets grab a hold of the ol preverbal “Volume Knob” and turn it all the way to the right, full volume……then rip the knob off! Lets make sure our Leaders in the Teamsters Union know that we ….. the Rank and File Members have had enough!

    Guess what….. TDU members that I have known for many years are NOT whiners, or complainers……..they are for the most part….. folks that get it done!

    TDU has been on the battle lines in the victories which have benefited the RANK & FILE for years, such as observer rights at contract votes, majority rule (51%) on contract votes, electing our General Executive Board through membership votes, pension reform and disclosures, salary disclosures of our leaders and Fat Cats, educating and informing the rank and file and the lists goes on…….you get the picture, right? Where have our leaders been in each of these battles? Usually on the “other” side of the battle line.

    THE COMPANY THAT I WORK FOR HAS GOT PROBABLY 75 TO 100 TRUCKS ON ARTILCE 48 AT DIFFERENT PLACES, RIGHT NOW, THEY HAVE GOT TRUCKS WHERE THE BUSINESS COULD BE HAULED BY THE OTHER SIDE OF A 2 WAY AGREEMENT, AND GOT THAT TERMINAL TRUCKS IN ANOTHER AREA UNDER ARTICLE 48 , HAULING BUSINESS THAT THEY COULD BE BACKHAULING WITH A TERMINAL IN THAT DIRECTION, I’M SURE IT’S SO THEY CAN SHOW THE UNION ALL THE MONEY THAT THEY ARE PAYING OUT ON PERDIEM, SAY 100 TRUCKS AT 27 TO 31 A DAY THAT’S PROBABLY CLOSE TO $3,000.00 A DAY, THEN ADD MOTELS FOR HALF OF THAT SINCE THEY PROBABLY DO NEED ABOUT HALF OF THEM , ANOTHER $2,000.00 A DAY, SO THEY ARE WASTING $5,000.00 A DAY ON MOVING THERE TRUCKS AROUND, 150 THOUSAND A MONTH, WHEN THEY GO TO THE UNION NEGOATIONS NEXT MONTH AND SHOW THEM THE AMOUNT OF MONEY THERE PAYING, THEY WILL GET ANYTHING THEY WANT…..
