Employers Deny Job Rights to PTS Teamsters

In the wake of PTS’s closure, carhaul employers are trying to violate the national contract and deny the right of PTS Teamsters to follow their work.

This attack on our contract, our solidarity, and on Teamsters who struck when they were called out by the International Union cannot be tolerated. All these Teamsters ask is that Article 5 of the contract be honored by Jack Cooper, Allied, Cassens and Active Transportation.

At the national grievance hearing today, the employers refused to abide by the contract, and deadlocked initial cases, including Kentucky Local 651 vs. Cassens, and Dallas Local 745 vs. Jack Cooper. Those hearings will continue tomorrow, but the initial cases show that a stronger stand will be needed to protect our jobs and seniority rights.

    If PTS workers came to work and the doors were locked I wouldnt have any arguement for their seniority rights, but this is not the case.. Allied drivers understood what would have happened if they didnt except the pay reductions, they did and their still working..PTS drivers rolled the dice and lost…now me and 40 other drivers some of who transferred cause our work was given up by the our company now face losing our jobs cause PTS drivers struck their company out of business…PTS drivers opened a can of worms…Ur former owner is still in,changing ur PTS logo to Allied as we speak, Uniited road is hauling PTS freight ,some of ur drivers who are being absorbed are looking at pay cuts. So who benefits from the strike and closure..the most senior men..and the question is asked why united road and others are taking our freight? maybe because the junior guys the future of the teamsters are dissatisfied and fed up with constantly being stepped on. But realize this, PTS went out of business while u guys struck..at that point You had no work 2 claim your own, you gave up that right ,just as u gave up the right 2 claim severence, vacation, and unemployement . The union has scrabled to force u guys down our throat but were not going 2 stand by and get stepped on cause u guys lost.. In my barn my shop steward went out on comp the day before u guys struck, that was the first sign., he wont return any active drivers call, and he has said he will not take any greveinces….see a pattern here? The teamsters is a democracy not a autonomy….Cassens and Allied have sent u 2 the bottom of their list……why isnt Active doing the same?

    Not sure what you are talking about^^^^???? Allied voted their pay cut in, we at PTS did not. It was forced. We did not only strike because of the 15% pay cut that piece of shit company shoved down our throats, but our spineless ceo walked away from the negotiation table saying he had a phone call to take and never returned!!! For me going to the bottom of the senority list at a different shop is not much of an issue, i only had three years in but these guys with 25/30 years in and not old enough to retire, why should they go to the bottom? They have put their time in, not only with PTS but with the union. We did not “lose”, the company lost, imo! As i stated, i only had three years in but this company was going down hill, FAST, from the time i started back in 2005.

    teamster carhauling is dieing by the second, and i love it cuz us over here at united road just signed a three year deal with toyota & gm, and the funny part is that u teamster r getting f**ked by ur leadship in dc. now ask ur self y would they let allied impose 15% but would not let pts impose 15%, is it becuz of ron burke and his pomises to hoffa & zuckerman, but not one of u teamster dare fight against them selling u out but ur quick to say its the non-union carriers destorying the business.. ask urself that, its ur very own leaders that r selling u out… yeah we dont make as much on a load as the teamsters, but at the end of the day i can go buy a house and not worry about a pay cut or my source of income going under..

    You keep telling yourself that driver, they can cut your pay in a heartbeat. Ask the NLRB what u are, you are considered a at will employee, which means you can have your pay cut or be terminated at any time. Also ask some of your fellow United scabs how long they worked for them 2 -3 years at the most,ask Union drivers how long they worked on average 10-20 years. From what i see you guys cant haul cars for shit you sure the fuck dont know how chain them down and cant haul more than 8 . Hope you find a bridge. i

    That united driver is exactly right!!!!!!!! our union fucked me and every other driver in the fleet. They had one goal with this strike, closed PTS to make the other three for profitable, that’s it. I was with PTS only 3 years and this piece of shit union never did anything for me and have no plans on doing anything for me even after i stood on a picket line for 5 straight days fighting for our rights and what we beilieved was ours. I will NEVER go to work for a union carrier again…….United, here i come and fuck the TEAMSTERS!!!!!!!!!!!!!!!!!!!!!

    If you ever organize dont go Teamsters… they are a self serving crooked organization. They still have gave no explanation as to why they were all for Allied taking wage cuts but not PTS and why they didnt bring the last offer for the membership to vote on.

    Well, all I realy got or can say is that this is the weirdest thing I have ever seen. I have read many of these post and they are all what is know. Let me add alittle to it by stating what Transpired with my affiliation and opinion.

    First day of PTS Strike. Was there at the Dallas Terminal as it started. Business Agent and other rep, (Not Reps) from roadway showed up too. Now this was my first Strike as a employee. Seen many of them as a kid with My Father. (lol, Todays are nothing like those. Every Teamster mCompany would Honoir the other)). Anyways, theories went fliying and we mad our scheduals for the rest of the week. Mine Next day…

    Ok, next day showed up and the Business agent was just leaving saying the STRICK WAS OVER!!!! Make sure you got that right. So I stayed with the others that just walked and the ones that were to with me. We get a call, “GO to Jack Cooper, they got the business. So off we went and called everyone on the way. Phisycals, exray, Drug test were done.

    Next day, PTS calls us to report to work since there is no Picketline or Strick. I and others talked about it and I decided to go. Trying to reach the business agent on the way. I got to the parking lot and was talking to the management inside @ PTS. They said, come on we got loads with revenue on them under PTS name.

    While I was still waiting for the business agent to call me before entering the Premises, I noticed 15 + Jack Cooper Trucks on OUR (PTS) yard loading our FORD TRAFFIC. I thought, this is weird. Here it is we are going over there and they are already here hauling our freight.

    Then the phone rang as it was the business agent. Told him what was said by PTS management and that they have have the Ford Contract and want us to return to work since their is no Picketline or seem to be a Strick going on. The business Agent assured me that the Strick was Real and Going on and to not get out of my Car. I said OK, but if we are on Strick, why in the Hell is Jack Cooper here hauling our Freight? (Which is nothing but pure BS and no BrotherHood at all) He said to me, “TRUST ME”.

    Well as we all know now, that Trust has gotten us put out of a Job. Oh yeah, we are at Jack Cooper. But I have never in my life felt the seperation of supposibly in the same brotherhood as I feel there. Kinda like a Racial Thing I would suppose.

    I have a JC Driver there that has many Years and I have known him for a little. He told me that they (JC) would never let us follow the work with a dovetail. Boy was he right. Since he was right about that I guess he was about this too. He stated, “Boy we FUKED YOUR FELOLOW GUYS (PTS).

    Now, if that is what the UNION is TODAY, I don’t want any part of no more. Brother Hood MY Ass. I really am sorry for you Senoir Hands @ PTS. I am still young enogh to go some where else. I really feel for you guys. Now, that is my story and how it unfolded for me. Good Bye…

    PTS Strike Over—National Bargaining Continues This Week
    June 17, 2008: The Teamster strike at PTS has closed a company that was already on the way out. The fight now is to safeguard 100 percent of the PTS Teamsters’ jobs at union carriers.

    Rest of the story.

    Today there is a hearing in Romulus, Mich. on seniority issues at some 15 locations. Teamsters from many terminals are attending the hearing.

    PTS Teamsters in many areas are nervous because they have seen nonunion operators like United Road Service, Sierra Mountain and Accurate Auto Carriers hauling PTS’s former traffic. Mechanics, yard and office Teamsters are also concerned for their jobs. They were as much a part of the strike as the drivers.

    Recently the International Union bragged in a press release how they did exactly that, with the help of the UAW, to protect yard Teamsters in Local 89, the home local of Carhaul Director Fred Zuckerman. It’s time to do the same for all PTS Teamsters, including yard workers, mechanics and office personnel.

    Let’s make sure that the strike accomplishes its goal: all PTS work must go to union carriers, and PTS Teamsters have the right to follow their work.

    The time to protect good Teamster jobs is now.

    Just spoke with a friend of mine that works for allied in wayne, mi. Cooper came in a took the focus traffice after we (PTS) went on strike and the company closed their doors. He and the other 14 drivers at the allied terminal were told today that cooper will take the enitre yard over effective august 18th and will be dove tailed into cooper. They were also told that the bottom 8 (OF 15 DRIVERS) have less senority than the lowest driver for cooper and will be out of a job….More teamster jobs falling to the waist side. Lets see if the local union does as much for them as they have done for me and the other 141 drivers out my terminal that stood up and lost our jobs…..NOTHING!!!!

    Maybe Some Changes here…

    Just got word that the PTS Employess from the Mesquite yard will Split from the Jack Cooper Board Sunday Night. This means that those PTS Employees will go back to hauling the Ford Freight as a Jack Cooper Driver at that time with their Senority Rights as they were as a PTS Employee at the Mesquite Yard. This remains to be seen on how this will work. I haven’t gotten the full detail other than the Drivers will still have to meet for the equipment at the Jack Cooper Yard in Arlington… Finally a Step in the right Directions for these Union Members of that flow of Traffic.

    To the United Road scab! First of all, only an uneducated idiot would want to load next to another company, that their drivers makes more than you. You have to pay for your benefits, and get 25% of what the load pays. What exactly does the load pay? You wont be able to answer that, because your slave driving company wont tell you the facts. That makes you a loser scab, that has to work 18 hrs a day to make what we TEAMSTERS make in 8 hrs. We Teamsters are professional car haulers, and the dealers wish they had us and not you. Your damage ratio is sky high, because your so busy trying to buy that house, and we already bought it. Ass bucket! Did you know that when you loser’s have to load at an auction you have to walk. When a Teamster gets to an auction, we get a shuttle.
    Perfect Scab Scenario!!! You wake in the mourning and you think life is grand, (In your little white and blue United Road truck) and you go into a new terminal. There you get a shit load and you say, darn this sucks. Then you see the terminal managers golf buddy FRED come in, and talk about what a good time they had the night before at the nude bar. Shortly after Ole Fred comes out with a dream load, that pays a whooping $800 to go to California from Michigan. (SCAB RATE!..lol) Then you wonder wow! I wish I was a teamster. As for Hoffa and his boys they will be dealt with, and we will continue to get pensions, benefits, and more money than you scab.

I don’t mean to bash a fellow teamster brother, but Allied drivers should of had the balls that PTS drivers had, and voted the pay cut down. You must not be able to put 2 and 2 together, but Allied never really had financial problems. They never reinvested into Allied Automotive Group, they took the profits and dumped it into other projects and companies. How do you think they had the 64 million dollars, 6 months after you took the pay cut to buy PTS and give 6.5 million in bonuses for you guys to vote yes. Your grand yes vote is what brought all of this to the forefront. That was the start of the end for car hauling. I hope your not getting a ballet in the mail, because we are sure to be doomed, if there are more drivers like you. You sure you don’t work in dispatch, because you sound like Roscoe.

    When PTS lost the Toyota work you drivers were not on strike and PTS was still doing business. Under the free trade zone agreement that the imports have with our government we can’t strike or others will haul away the work. LOOK IT UP! Therefore you should not dove tail into those locations. Under article five you guys who lost the the other work because PTS was not doing business you should of been able to dove tail into those terminals. Many of us know that the Union has sold us all out for what ever reason, but we must stand up and take our Union back at all cost. The system is not perfect, but I understand what you guys are going through. The key is to protect what little we have left and fight for our carriers. The last thing we need is to fight among-st each other, and loose sight of our futures. These companies and our Union have a simple point of view, and that is to conquer is to divide. If we are divided, they win. That is the oldest war propaganda in the book! Like in battle you must have heart and work together to win. What are we wining you might ask? We are in fight with big business and politics, that is consuming us all. This are life changing issues that are being brought upon us on purpose, so we loose sight of the contract that is being shoved up our asses. Dove tail and end tail wont mean crap if they eliminate article 48, and start a two teer wage for new hires. If the contract flies it won’t matter and we loose the way of life we all share, and our families suffer the consequences of our mistakes. Lets come up with ways to take back our Union, and our way of life. I’m willing to sacrifice everything I know and love for a good fight, are you?

    Leasewayover I have to believe that you are either Canadian, management, or out of touch. We all knew what was at stake. NO ONE sold us down the river. Have you EVER spoken to any Allied drivers? Most if not all of them regret ever voting for their own pay cut. They feel totally screwed. Why would the union make the same mistake again. There were very few American PTS drivers who were willing to take that 15%. EVERYONE knew it including the union. The day we walked out we already knew that PTS would be out of business by the end of the week. It sucks to be out of carhauling for the time being but it sure felt good on Friday the 13th June 2008 when it all came tumbling down and we were on the right side. WE BROUGHT THEM DOWN! Unlike the ENRON debacle. We we NOT THE VICTIMS.

    BTW our BA was in Cleveland on the day that Black Diamond pulled the funding. He told us that PTS wanted another 15% in addition to the original 15% to make up for the money they lost during the strike. So now we’re supposed to go back to work with a 30% pay cut? Gimme a break!

    authorizes a DOVETAIL regaurdless of ” whether the transaction is called a merger,purchase,acquisition,sale,etc. WHAT THE HELL.

    Nobody could have predicted this outcome more then a weatherman can predict the long range forecast. Your statement of an additional 15% cut is an example of false rumours that were spread for the sole purpose of destruction. Dont you at least wish you guys had the chance to vote on a contract? Decide for yourselves? You have been sacrificed like lambs. If you guys were allowed to take the reduced wage ( 15%) which would be on par with Allied you guys could have decided your own future and in your own time frame. This was no Enron.

    I think all you union supports are crazy as hell. The union expressly said that they were going to PTS out of business. Since when does a union have the right to decide who stays in business and who has to shut down. If PTS was in that much trouble it would have gone under on its own. What right do they have to step in on it. Your leaders are probably on the take with Allied. Did you ever think of that. If they were so worried about the drivers and the paycut why didnt they lower you dues to help you out? Think about how much that union takes in with the dues a year. Where is all that going? In to their pockets and high saleries? The unions did have a place about 50 years ago but times change. They now seem to feel that they own everything and make promises that they can’t keep. Wake up and smell the roses! Not only did they put drivers, mechanics, and yard people out of work they cant keep their promises to them now. The whole union should be overhauled with new people in charge who care about the union employes and step up with the times. Those of you who think that is no big thing to be out of work just wait awhile when you savings are gone and your homes are in forclosure.

    Leasewayover: ARE YOU MENTAL?!? You must be on some other planet. The company lost 11 million dollars in the first quarter. They were in default on the loan to Black Diamond. The second lein holders were trying to get PTS liquidated in chapter 7. This was all before the strike even started.

    June 3 (Bloomberg) — Performance Transportation Services Inc., the second-largest car hauler in the U.S., should be liquidated immediately to stem losses averaging $4.5 million a month since the Chapter 11 filing in November, secured lenders CIT Group/Business Credit Inc. and Bayerische Hypo-und Vereinsbank AG, New York Branch, recommended to the bankruptcy court in papers filed May 30. The motion by the revolving credit lenders is scheduled for hearing on June 20.

    The two lenders contend there is no reasonable likelihood of reorganization.

    The Chapter 11 case shifted into a new gear last week when the company filed a motion saying it needs an interim 15 percent wage reduction from workers represented by the Teamsters union or the company “will be forced to liquidate.\’\’ The motion to impose lower wages was put onto the calendar for a June 4 hearing. U.S. Bankruptcy Judge Michael Kaplan in Buffalo, New York, said he might decide that the union hasn\’t been given enough time to answer.

    Madashell: There is one flaw to your theory. By putting us 1500 or so PTS employeesout of union carhaul, they also are going to have to go without those dues they so desperately need according to you. At $44.38 per 1500 dues paying members that comes to $66570.00 per month! Why would they throw all that money away you claim was only lining their pockets? Hell at the 15% pay cut rate it still comes to $56580.00 per month. Seems to me that you’re the one not thinking it through because by your logic they would have been FOR the pay cut instead.

    As far as another teamster web site I had one. TerminaLink.com also known as thecarhauler. It had private rooms with verified teamster members even a Private Stewards office. The problem was the costs were high and Carhaulers just won’t use it or the Internet for that matter. So I put up this cheap site that’s not good enough and still the response is small. This site average is only about 250 to 300 a day and most do not post or sign up. After this contract thing passes readership will just fall off to nothing.

    Most members are now Contributors, which means you can write your own post. As long as it is not some hate speech I will Publish it so just jump on in. If you find you are not a Contributor just ask and I will upgrade you

The Big 3 have been attempting to divert all union carhaul work to non-union carriers for years, and its working. If you didn’t realize that you live under a rock. Instead of pointing fingers at non-union carriers taking your work, you should be complaining to your Union for lack of organizing them. Jr.Hoffa is no better than his Dad.     I think you need to read my post , nowhere have i ever blamed non-union carrier’s taken business, and the writing has been on the wall since about ‘85,after the strike that we kept the 2 tier wage’s from coming in, that freight let get started then, that’s when they started getting rail lots, and they have been getting more and more ever since, one of the prominent non=union carriers is less than a mile from the local in dallas, there everywhere, we have another one that has probably 100 trucks in the area hauling kia’s,mitibushi’s,and volkswagens,another one in houston probably has 150 drivers, most of them x-union drivers hauling toyota’s, bringing home more money than we can now, and they will be making 30 to 40% more than we do if this contract get’s through. the union has been doing things ,they haven’t been doing nothing, they have been having meetings in places like naples, fl in the winter time , and whitfish mt. in the summet time, phoenix in the spring, working hard playing golf, all at our expense, they have the life’s of CEO,’S of a major business, which that is all the union is now is a business, a business to create jobs to pay into the health and wefare fund’s to keep it afloat, they don’t care about there drivers standard of living at all, it’s evident. but if i’m going to have to stay out 5 tours, whatever a tour is,it’s not going to be in a pos truck, making peanuts , if they want to me stay out 5 tours , making peanuts, i want a chromed up large car that will run about 120. AND NOT ONE PERSON HAS BEEN ABLE TO EXPLAIN WHAT A TOUR IS GOING TO BE.

    You are exactly right non-union wages for carhaul now exceed that of Teamster carhaulers, and the equipment is FAR better. Not to mention non-union shops do not have a million rules to follow in order to keep your job. You simply go out and haul cars. Theres no bickering either amongest the drivers like there are at Teamster barns. The Union has allowed the companies to pit driver against driver and tear apart the unity that used to be TEAMSTER from back in the 70’s, and thats sad. The simple fact is there should be no hard feelings between union and non-union carhaulers. We are all professionals doing the same job. I would like to see more Teamster carhaulers come over, because I know that they can do the job. I was a Teamster for 15 years and resigned and bought my own 10 car in 1999. It was the best move I ever made. I now haul the freight I want to haul for the rate I want, which averages about $4 per mile. My advice to all the professional Teamster drivers is to just buy your own truck and find your own freight, theres plenty out there. And I know for a fact that non-union company drivers average $1500-$1800 a week driving really good equipment. My personal opinion is that the day of Teamster carhaul is all but over, and I feel for you guys and have no hard feelings whatsoever.

Anyone with any common sense knows that this new contract is going to pass because the Teamster BIG WIGS want it to. They’ll just keep revising it until you get sick of voting on it with same language and cram it down your throut anyway. Thats how the Teamsters work now. They know its a terrible contract but also know who holds all the cards, and its not them! And you’ll never get a straight answer from any BA from any local because the INTERNATIONAL will not allow them to. The BA’s are there basically to reinforce the Internationals position and push it through. He’ll stand up and tell you that the companies need these concessions to compete. What a crock of crap. If you had a clue as to how much money the Cassens, Allieds, E&L, and JC’s are making every year it would make you ill. And the Teamsters need that money to survive and they’ll give away your soul to keep it coming in. The Teamsters have been in these companies pockets for years and that will not change. The Teamsters cannot afford to lose carhaul revenue after all the losses they have had in the last 2 decades. So they’ll just pass the losses on to their members as usual. Its quite simple to understand really and has nothing to do with non-union carriers. But it is a nice front to put up!
